Beneficial ownership registers after the EU court ruling
Corporate transparency is a rising keyword in the management journals, while beneficial ownership barely appears in the archive. In November 2022 the EU Court of Justice struck down general public access to the registers of companies' beneficial owners. Did the return of anonymity bring back shell companies and opaque property purchases?
What prompted this#
In the management journals, "corporate transparency" had 5 papers in July–September 2026 against about 2 expected, and in economics "transparency" grew too (9 against 4); see the trends page. Since October 2025, "corporate transparency" appears on 50 papers (29 in finance journals), but "beneficial ownership" on just 2 and "anti-money laundering" on 14.
Questions#
- After several EU countries closed or restricted public access to their registers, did new companies with opaque ownership become more common?
- Did purchases of property through companies change in countries that closed their registers, compared with countries that kept them open?
- Do journalists, banks and tax authorities find fewer red flags without public access?
Data that could help#
Company registers and ownership data (Orbis ownership, Open Ownership), property transactions with corporate buyers, and the dates on which each country restricted access.
Next step#
List which EU countries closed, restricted or kept public access to their registers after the ruling, with dates, and count new company formations by legal form around those dates.
